1. Acceptance of Terms

By downloading, installing, or using MagicShot.ai (referred to as the “App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. License and Use of the App

2.1 License

MagicShot.ai grants you a limited, non-exclusive, non-transferable, revocable license to use the App.

2.2 Restrictions

You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App.

3. User Conduct

3.1 Prohibited Actions

You agree not to engage in any activity that may interfere with or disrupt the App, including but not limited to hacking, data scraping, or any unauthorized use of the App.

3.2 User Content

By using the App, you may submit content. You retain ownership of your content, but you grant MagicShot.ai a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display the content in connection with the App.

3.3 Prohibited Activity

By using the App, you agree to using the App for generating legal content only. Any content that is deemed unlawful will be deleted and your access to the App will be blocked. This includes, but is not limited to, inappropriate content that exploits or harms children.

3.4 Public Figures

By using the App, you agree that you will not generate content including videos or images that resembles public figures including celebrities and politicians.

3.5 Real People

By using the App, you agree that you will not generate NSFW content including videos or images of real people.

4. MagicShot Community

The MagicShot Community is a social space where users can share their AI-generated creations, interact with other creators, like and comment on posts, and follow other users. By participating in the Community, you agree to the following.

4.1 What You Can Post

Community posts are limited to content generated through MagicShot’s platform tools and saved to your MagicShot Gallery. You cannot upload images or videos from your local device directly to the Community.

4.2 Prohibited Content

The following content is strictly prohibited on the Community:

  • NSFW, sexually explicit, or pornographic content
  • Nudity, graphic violence, or disturbing imagery
  • Content involving or targeting minors in any harmful way
  • Political propaganda or divisive political content
  • Region-restricted content that violates local laws or regulations
  • Hate speech, discrimination, or harassment based on race, religion, gender, nationality, or any other protected characteristic
  • Impersonation of real individuals, celebrities, or public figures
  • Spam, misinformation, or deceptive content

4.3 Moderation & Enforcement

MagicShot.ai reserves the right to remove any content that violates these terms. Depending on the severity or frequency of violations, we may issue warnings, restrict posting access, temporarily suspend, or permanently ban an account from the Community or the entire platform.

4.4 Reporting

If you encounter content that violates these terms, please report it to support@magicshot.ai.

5. Intellectual Property

MagicShot.ai owns all rights, title, and interest in and to the App, including all intellectual property rights. You may not use our trademarks, copyrights, or any confusingly similar marks without our prior written consent.

6. Refund Policy

We strive to provide high-quality AI-generated content through our platform. If you believe that the content you received is of low quality or the generation process failed entirely, you may be eligible for a refund. Refund requests are considered on a case-by-case basis and must be submitted within 7 days of the original transaction. We reserve the right to deny refund requests that do not meet these criteria or are deemed to be in violation of our Terms of Use.

7. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind, either express or implied. MagicShot.ai does not warrant that the App will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, MagicShot.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

MagicShot.ai reserves the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users. Severe or repeated Community violations may result in permanent account termination.

10. Changes to Terms of Use

MagicShot.ai reserves the right to update these Terms of Use. Any changes will be posted on this page with an updated effective date.
