1. Acceptance of Terms
By downloading, installing, or using MagicShot.ai (referred to as the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
2. License and Use of the App
2.1 License
MagicShot.ai grants you a limited, non-exclusive, non-transferable, revocable license to use the App.
2.2 Restrictions
You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App.
3. User Conduct
3.1 Prohibited Actions
You agree not to engage in any activity that may interfere with or disrupt the App, including but not limited to hacking, data scraping, or any unauthorized use of the App.
3.2 User Content
By using the App, you may submit content. You retain ownership of your content, but you grant MagicShot.ai a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display the content in connection with the App.
3.3 Prohibited Activity
By using the App, you agree to using the App for generating legal content only. Any content that is deemed unlawful will be deleted and your access to the App will be blocked. This includes, but is not limited to, inappropriate content that exploits or harms children.
3.4 Public Figures
By using the App, you agree that you will not generate content including videos or images that resembles public figures including celebrities and politicians.
3.5 Real People
By using the App, you agree that you will not generate NSFW content including videos or images of real people.
3.6 NSFW Content, Inputs, and Automated Moderation
MagicShot.ai does not permit the generation of NSFW, sexually explicit, or otherwise prohibited content. This prohibition applies equally to inputs: you may not upload, submit, or otherwise provide NSFW images or videos as source material for any tool, including material sourced or downloaded from NSFW, pornographic, or adult websites, regardless of whether you have rights to that material.
All prompts and uploaded content pass through automated content moderation before and during generation, and generated results may also be reviewed after creation. Attempts to bypass or circumvent our moderation systems, including reworded prompts, encoded language, or manipulated images intended to evade detection, are themselves a violation of these Terms.
Removal. Content that violates these Terms or our Content Policy may be removed within 24 hours of detection, whether detected at generation time, through later review, or through a user report. Removals may be appealed as described in Appealing a moderation decision; content remains removed while an appeal is under review, and MagicShot.ai's decision following review is final.
Suspension. Repeated attempts to generate NSFW content, as determined by MagicShot.ai, may result in a temporary suspension of your account for 24 hours and removal of the violating content. Continued or severe violations may lead to permanent account termination without refund. Content that is illegal, including any content involving minors, results in immediate permanent termination without prior warning, and may be reported to the relevant authorities.
4. MagicShot Community
The MagicShot Community is a social space where users can share their AI-generated creations, interact with other creators, like and comment on posts, and follow other users. By participating in the Community, you agree to the following.
4.1 What You Can Post
Community posts are limited to content generated through MagicShot's platform tools and saved to your MagicShot Gallery. You cannot upload images or videos from your local device directly to the Community.
4.2 Prohibited Content
The following content is strictly prohibited on the Community:
- NSFW, sexually explicit, or pornographic content
- Nudity, graphic violence, or disturbing imagery
- Content involving or targeting minors in any harmful way
- Political propaganda or divisive political content
- Region-restricted content that violates local laws or regulations
- Hate speech, discrimination, or harassment based on race, religion, gender, nationality, or any other protected characteristic
- Impersonation of real individuals, celebrities, or public figures
- Spam, misinformation, or deceptive content
4.3 Moderation & Enforcement
MagicShot.ai reserves the right to remove any content that violates these terms. Depending on the severity or frequency of violations, we may issue warnings, restrict posting access, temporarily suspend, or permanently ban an account from the Community or the entire platform. Notwithstanding this escalation, violations of Section 3.6 (NSFW content and inputs) and any illegal content are enforced as described in Section 3.6 and are not subject to a prior warning.
4.4 Reporting
If you encounter content that violates these terms, please report it to support@magicshot.ai.
5. Intellectual Property
MagicShot.ai owns all rights, title, and interest in and to the App, including all intellectual property rights. You may not use our trademarks, copyrights, or any confusingly similar marks without our prior written consent.
6. Refunds and Cancellation
Refunds of credits and payments are governed by our Refund Policy, and subscription cancellation is governed by our Cancellation Policy; both form part of these Terms, and in case of any conflict regarding refunds or cancellation, those policies control.
In summary: generations that fail for technical reasons are re-credited 100% automatically; generations blocked by content moderation for NSFW prompts or input images are re-credited 50%, with the remainder restored only if an appeal confirms the block was a false positive; delivered results are not refundable on grounds of taste or quality; and accounts terminated for violations receive no refund of credits or fees. Credit refunds return credits to your balance and never convert to a monetary refund. You may cancel your subscription at any time; cancellation stops future billing and you keep access until the end of the paid period.
7. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, either express or implied. MagicShot.ai does not warrant that the App will be error-free or uninterrupted.
8. Limitation of Liability
To the maximum extent permitted by law, MagicShot.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
9. Termination
MagicShot.ai reserves the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users. Severe or repeated Community violations may result in permanent account termination.
10. Changes to Terms of Use
MagicShot.ai reserves the right to update these Terms of Use. Any changes will be posted on this page with an updated effective date.
